The agreement between you and Capstone Metals covering orders, pricing, payment, shipping, cancellations, buy-backs and liability.

Welcome to Capstone Metals. These Terms & Conditions (“Terms,” “Agreement”) govern your access to and use of the Capstone Metals website, capstonemetals.com (the “Website”), and your purchase of precious metals and related products through the Website.

By accessing the Website, creating an account, submitting an order, or purchasing products from Capstone Metals, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Website or purchase products from Capstone Metals.

ABOUT CAPSTONE METALS

Capstone Metals is a precious-metals e-commerce business offering gold, silver, and other precious-metal products and related products and services.

Capstone Metals reserves the right to modify, suspend, or discontinue any portion of the Website or any product or service offered through the Website at any time, subject to applicable law.

ELIGIBILITY TO PURCHASE

You must be legally permitted to enter into contracts and purchase precious metals under the laws applicable to you.

By placing an order, you represent and warrant that:

Capstone Metals reserves the right to refuse or cancel an order when permitted by law, including when information provided by a customer cannot be verified or when Capstone Metals reasonably believes a transaction may violate applicable law or company policies.

PRODUCT INFORMATION

Capstone Metals makes reasonable efforts to ensure that product descriptions, photographs, specifications, pricing, availability, and other information displayed on the Website are accurate.

However, precious-metal products may vary in appearance, including differences in coloration, finish, minting characteristics, packaging, and other physical characteristics.

Product images are provided for illustrative purposes and may not always represent the exact item, packaging, year, mint mark, or condition supplied.

PRECIOUS-METAL PRICING

Precious-metal prices are affected by rapidly changing market conditions. Prices displayed on the Website may change at any time.

An order is not considered final and binding until Capstone Metals has accepted the order and confirmed the applicable purchase price in accordance with its ordering procedures.

Capstone Metals reserves the right to correct pricing errors, typographical errors, product-description errors, and other inadvertent inaccuracies.

If an error affects an order that has already been submitted, Capstone Metals may contact the customer regarding the error and may, where permitted by law, cancel the affected order and refund any payment received for that order.

ORDERS AND ORDER ACCEPTANCE

Submitting an order through the Website constitutes a request to purchase the selected products. It does not necessarily constitute acceptance of the order by Capstone Metals.

Capstone Metals reserves the right to accept, reject, limit, or cancel an order for any lawful reason.

Orders may be subject to identity verification, payment verification, fraud screening, availability, market conditions, and other compliance procedures.

Capstone Metals may require additional information before processing an order.

PAYMENT AND GOOD FUNDS

Payment must be received and confirmed by Capstone Metals before an order is shipped unless otherwise expressly agreed in writing.

For purposes of these Terms, “good funds” means payment that has been received, cleared, and is available to Capstone Metals without restriction or risk of reversal.

Payment methods may be subject to processing times, verification requirements, transaction limits, or other restrictions.

Capstone Metals reserves the right to delay shipment until payment has fully cleared.

Customers are responsible for providing accurate payment and billing information.

SHIPPING AND DELIVERY

Orders are shipped using carriers and shipping methods selected by Capstone Metals.

Upon receipt and confirmation of good funds in full payment of the purchase price, Capstone Metals will make reasonable efforts to ship purchased metals within five to fourteen (5–14) business days.

Due to precious-metal market fluctuations, product availability, payment-clearing requirements, inventory limitations, or other circumstances, an order may in some circumstances require additional processing time.

The original terms provided that an order may take up to forty-five (45) business days after receipt of good funds under certain circumstances. Capstone Metals may retain a similar provision if it accurately reflects the company’s actual fulfillment practices.

Personal checks, where accepted, may require additional time to clear before an order is processed or shipped. The source document states that personal checks required a minimum of twelve (12) days to clear the company’s bank account.

Estimated delivery dates are estimates only and are not guaranteed unless expressly stated otherwise.

INSURED SHIPMENTS

Precious-metal shipments may be sent using insured shipping services.

Where Capstone Metals provides shipping insurance, coverage applies during transit in accordance with the applicable carrier and insurance terms.

A signature may be required upon delivery.

Customers are responsible for providing a secure and accurate delivery address and for following carrier delivery requirements.

LOST OR STOLEN SHIPMENTS

If Capstone Metals determines that a purchased item was lost or stolen while in transit through a common carrier, Capstone Metals may, subject to applicable law and the terms of its shipping insurance:

  • Refund the purchase price of the affected item; or
  • Replace the affected item.

The original source document states that refund or replacement constituted the customer’s exclusive remedy for items determined to have been lost or stolen in transit.

Capstone Metals will not be responsible for losses occurring after delivery or where a customer has instructed a carrier to leave a package unattended, leave it at an unauthorized location, or deliver it to another person or location.

Customers should carefully review delivery instructions before authorizing unattended delivery.

CUSTOMER DELIVERY INFORMATION

Customers are responsible for providing complete and accurate shipping information.

Capstone Metals is not responsible for delays, additional costs, or losses resulting from an incorrect or incomplete address supplied by the customer.

If a shipment is returned because of an incorrect address or failure to accept delivery, additional shipping or handling requirements may apply.

ALL SALES OF METALS ARE FINAL AND NON-REFUNDABLE

Capstone Metals does not accept returns, exchanges, or refunds on physical precious metals of any kind, including bullion, certified coins, and graded numismatic pieces. Every metals sale is final once the order is submitted and the price is locked.

The reason is straightforward. Precious-metal prices move constantly, and a certified coin can be removed from its holder, altered, substituted, or exchanged for a lesser piece once it leaves our custody. We cannot verify that an item returned to us is the identical item that shipped, so we do not accept returns at all rather than expose other customers to that risk.

A change of mind, a subsequent move in the spot price, or a change in a customer's financial circumstances is not grounds for cancellation, return, or refund, and Capstone Metals is not liable for any of those events.

Every item is photographed in hand, described in detail, and — where certified — identified by grading service, grade, and certificate number before purchase, so customers can confirm exactly what they are buying before they submit an order.

The only exceptions are items lost or damaged in transit, which are handled under the insured-shipment provisions above, and a documented shipping error by Capstone Metals, where we will correct the error at our expense.

Orders become non-cancellable at the moment the price is locked and the order is submitted. Applicable taxes and shipping are not refundable.

Nothing in these Terms is intended to eliminate or restrict any consumer right that cannot lawfully be waived.

TAXES

Customers are responsible for applicable sales, use, excise, or other taxes associated with their purchase, except to the extent Capstone Metals is legally required to collect and remit such taxes.

Tax treatment of precious-metal purchases may vary depending on the customer’s location, the type or value of the products purchased, and applicable law.

CUSTOMER ACCOUNTS

If the Website permits customers to create an account, customers are responsible for maintaining the confidentiality of their account credentials and for all activity conducted through their account.

Customers agree to notify Capstone Metals promptly if they believe their account has been accessed without authorization.

Capstone Metals reserves the right to suspend or terminate an account when reasonably necessary to protect the Website, customers, the company, or third parties, or to comply with applicable law.

PROHIBITED USES
